PROBLEM FACED BY STATELESS ROHINGYA REFUGEES IN MALAYSIA.

1. Arrest, detention and deportation.

● since the Malaysian government do not recognized refugees, the Rohingya refugees subjected to arrest, detention and deportation.
● In 2007, MERHROM received more than 1000 cases of arrest, detention and deportation of Rohingya refugees consisting of men, women, children and babies. The Malaysian authorities also arrest pregrant women, sick person and elderly.
● In 2008, MERHROM received about 200 cases of arrest, detention and deportation of Rohingya refugees.
● due to the raids, lots of Rohingya refugees ran into the jungle together with their family members. They face a lot of difficulties and danger while staying in the jungle.
● during the raids, there are some incidents where Rela break into their houses. It was also reported that their belonging and money was taken during the raids.
● most of the time they are not allow to use their hand phone to make call in the case of arrest.
● in the case of deportation to the Thailand border, a lot of Rohingya refugees became victms of human trafficking. Many Rohingya refugees falls into the hand of agents and traffickers at borders. Many of them became bonded labour.
● some Rohingya refugees were missing and in some incident they were shot to death by the agents / traffickers.

2. No Access to work.

● the refugees do not have legal document to work. Most of Rohingya refugees had to work illegally in order to continue their living
● lots of Rohingya refugees were arrested while working and deported. Rohingya refugees do not have job security as they can be arrested at any time.

3. No access to Education.

● Rohingya refugees have more than 3000 children who cannot go to school. MERHROM officially wrote to the Education Minister to request for the entry to school but it was rejected by the ministry.

4. Malnutrition.

● due to the financial problem, a lot of Rohingya refugees especially children suffered from malnutrition.

5. Health.

● the Rohingya refugees who suffered serious health problem do not able to get proper treatment due to high cost of treatment. Although the government hospital give lower charge to refugees but still they are not able to pay when it comes to big amount.
● some refugees suffered from depression but they did not get any treatment.
● there are some cases of sudden death of Rohingya refugees.
● for the sick refugees at the detention camps, they did not get proper treatment.

6. Separation of Family.

● due to the raids, a lot of husband/father separated from their wife and children. The wife and children who left behind face a lot of difficulties to continue their living.
● in the case of both husband and wife was arrested, their children left behind without any attention and become street children. Some of these children found to be missing.

7. No Freedom of Movement

● due to no legal document, their movement was restricted. They are afraid if arrested by authorities.

8. Arrest of New Born Babies and Mothers

● in 2007, MERHROM received 20 cases of arrest of new born babies and mothers. Most of them were arrested by the immigration department at the National Registration Department. However in some incident they were arrested at the hospital.
● in one incident reported to MERHROM, a new born baby and the mother was arrested by the immigration department after 3 hours of her delivery. They were sent to the detention camp. 

9. Accommodation

● the refugees face a lot of difficulties in renting a house due to no legal document. Those who managed to rent a house decided to share with few families. It cause overcrowding in the house.

10. No Rights to form a family.

● Rohingya refugees face a lot of problem in order to get marry due to no legal document. The marriage among Rohingya refugees was done according to religion but not register with any parties.
● those who get married with local Malaysian did not able to apply for spouse visa due to no passport.
●those who get married with local Malaysia outside Malaysia e.g. Thailand facing problem in registering their marriage due to no proper document.

11. Harassment by Gangster and Local Public

● Rohingya refugees are subjected to harassment by gangster and local public due to no legal document.
● MERHROM received some cases of kidnapping, murder, threatening and extortion of Rohingya refugees by gangster and local public.
● due to the harassment, they have to stop working and hide themselves from the gangster. The gangster also harass their family members.

12. Unregistered Rohingya Refugees (Old Cases)

● there are many Rohingya refugees who stay long time in Malaysia but do not register with UNHCR due to various problem:
i) staying outside Kuala Lumpur
ii) fear of arrest
iii) do not know where UNHCR office
iv) de-motivated to register due to non recognition of UNHCR card by the Malaysian government.

13. Giving Birth in the Detention Camps

● there are cases of women refugees giving birth in the detention camp. There is no further information whether the mother and the baby was referred to doctor.

14. Rape of Women Refugees

● in the case of deportation, women refugees are very vulnerable to rape especially by the agents/traffickers at the border.

15. Witholding of UNHCR Card by the Immigration Department

● in the case of deportation, the immigration department withhold the UNHCR card. There is no information what happen to those UNHCR cards.

16. No Access to refugees at Detention Camp

● In the recent development, refugees are afraid to visit the family members and friends in detention camp due to the high risk of arrest especially by Rela at the detention camp.
● recently 2 women refugees (Myanmar Muslim) were arrested by Rela at Semenyih detention camp during their visit to their friend.

Intervention Needed from NGOs

1. Urge the Malaysian government to immediately stop the arrest, detention and deportation of refugees

2. Urge the Junta Myanmar to restore democracy in Myanmar and recognized Rohingya as citizen

3. Urge the Malaysian government to protect refugee women and children as guaranteed by CEDAW and CRC

4. Urge the UNHCR to equally process the Resettlement for Rohingya refugees. There are many Rohingya refugees who stay more than 10 years in Malaysia but did not get Resettlement.

<p>2.	No Access to work.</p>
<p>● the refugees do not have legal document to work. Most of Rohingya refugees had to work illegally in order to continue their living<br />
● lots of Rohingya refugees were arrested while working and deported. Rohingya refugees do not have job security as they can be arrested at any time.</p>
<p>3.	No access to Education.</p>
<p>● Rohingya refugees have more than 3000 children who cannot go to school. MERHROM officially wrote to the Education Minister to request for the entry to school    but it was rejected by the ministry.</p>
<p>4.	Malnutrition.</p>
<p>● due to the financial problem, a lot of Rohingya refugees especially children suffered from malnutrition.</p>
<p>5.	Health.</p>
<p>● the Rohingya refugees who suffered serious health problem do not able to get proper treatment due to high cost of treatment. Although the government hospital give lower charge to refugees but still they are not able to pay when it comes to big amount.<br />
● some refugees suffered from depression but they did not get any treatment.<br />
● there are some cases of sudden death of Rohingya refugees.<br />
● for the sick refugees at the detention camps, they did not get proper treatment.</p>
<p>6.	Separation of Family.</p>
<p>● due to the raids, a lot of husband/father separated from their wife and children. The wife and children who left behind face a lot of difficulties to continue their living.<br />
● in the case of both husband and wife was arrested, their children left behind without any attention and become street children. Some of these children found to be missing.</p>
<p>7.	No Freedom of Movement</p>
<p>● due to no legal document, their movement was restricted. They are afraid if arrested   by authorities.</p>
<p>8.	Arrest of New Born Babies and Mothers</p>
<p>● in 2007, MERHROM received 20 cases of arrest of new born babies and mothers. Most of them were arrested by the immigration department at the National Registration Department. However in some incident they were arrested at the hospital.<br />
● in one incident reported to MERHROM,  a new born baby and the mother was arrested by the immigration department after 3 hours of her delivery. They were sent to the detention camp.  </p>
<p>9.	Accommodation</p>
<p>● the refugees face a lot of difficulties in renting a house due to no legal document. Those who managed to rent a house decided to share with few families. It cause overcrowding in the house.</p>
<p>10.	 No Rights to form a family.</p>
<p>● Rohingya refugees face a lot of problem in order to get marry due to no legal document. The marriage among Rohingya refugees was done according to religion but not register with any parties.<br />
● those who get married with local Malaysian did not able to apply for spouse visa due to no passport.<br />
●those who get married with local Malaysia outside Malaysia e.g. Thailand facing problem in registering their marriage due to no proper document.</p>
<p>11.	 Harassment by Gangster and Local Public</p>
<p>● Rohingya refugees are subjected to harassment by gangster and local public due to no legal document.<br />
● MERHROM received some cases of kidnapping, murder, threatening and extortion of Rohingya refugees by gangster and local public.<br />
● due to the harassment, they have to stop working and hide themselves from the gangster. The gangster also harass their family members.</p>
<p>12.	 Unregistered Rohingya Refugees (Old Cases)</p>
<p>● there are many Rohingya refugees who stay long time in Malaysia but do not register with UNHCR due to various problem:<br />
i) staying outside Kuala Lumpur<br />
ii) fear of arrest<br />
iii) do not know where UNHCR office<br />
iv) de-motivated to register due to non recognition of UNHCR card by the Malaysian government.</p>
<p>13.	 Giving Birth in the Detention Camps</p>
<p>● there are cases of women refugees giving birth in the detention camp. There is no further information whether the mother and the baby was referred to doctor.</p>
<p>14.	 Rape of Women Refugees</p>
<p>● in the case of deportation, women refugees are very vulnerable to rape especially by the agents/traffickers at the border.</p>
<p>15.	 Witholding of UNHCR Card by the Immigration Department</p>
<p>● in the case of deportation, the immigration department withhold the UNHCR card. There is no information what happen to those UNHCR cards.</p>
<p>16.	 No Access to refugees at Detention Camp</p>
<p>● In the recent development, refugees are afraid to visit the family members and friends in detention camp due to the high risk of arrest especially by Rela at the detention camp.<br />
● recently 2 women refugees (Myanmar Muslim) were arrested by Rela at Semenyih detention camp during their visit to their friend.</p>
<p>Intervention Needed from NGOs</p>
<p>1.	Urge the Malaysian government to immediately stop the arrest, detention and deportation of refugees</p>
<p>2.	Urge the Junta Myanmar to restore democracy in Myanmar and recognized Rohingya as citizen</p>
<p>3.	Urge the Malaysian government to protect refugee women and children as guaranteed by CEDAW and CRC</p>
<p>4.	Urge the UNHCR to equally process the Resettlement for Rohingya refugees. There are many Rohingya refugees who stay more than 10 years in Malaysia but did not get Resettlement.</p>
